THE POWERS OF THE INVESTIGATION AGENCY HEAD IN PRE-TRIAL

Abstract

Decision of the legislator to appoint the official, who heads the investigative unit, head of the investigative body is recognized as valid. The advantage of the head of the investigative body in comparison to the prosecutor the proximity to the object of control (the actions and decisions of the investigator) is emphasized. The concentration of the investigative staff in the Investigation Committee is regarded as the best solution to the question of organizational forms of disclosure and investigation of crimes, to ensure the procedural autonomy of the investigator. The expediency of vesting the head of an investigative body with additional powers is justified: 1) to withdraw the materials of offence reports inspection from the investigator and transfer them to another investigator, 2) to provide the investigator with directions to conduct offence reports inspection.
