THE EVOLUTION OF CUSTOMARY LAW AND CRISIS OF REGULATION OF THE TRIBAL COMMUNITY

Abstract

Since the beginning of the Neolithic revolution justified intrapartum crisis of social regulation (mononormatik primitive law) and the occurrence of early forms of law customary law as intra-regulatory compromise between the millennial egalitarian traditions and strengthens private interests. The evaluation of the social and legal consequences of institutionalization of patriarchy in tribal community is considered.
